Creating a small business is an exciting milestone in your life. However, in order to be successful, you must tackle legal issues head-on. If you neglect the necessary paperwork, you may face liabilities that could potentially put you out of business.

Getting all the formalities figured out is not very fun or creative, but it is necessary. Here are some important legal considerations for your company.

1. Choosing the proper entity type

Is your business a sole proprietorship, LLC, partnership or corporation?

If you have not thought about your business structure much, do so now. Once you determine you have the right formation, running your business and paying taxes will be a lot easier.

2. Protecting your name and ideas

You spend a lot of energy and money establishing your brand. However, it can all go away without the right protections.

Obtain a trademark for your business name and apply for any copyrights or patents that are necessary.

3. Hashing out employment agreements

When you are first starting out, your attitude towards your employees may be informal. You may be relying on oral agreements. But if your company is starting to grow, you should take another look at your agreements.

Without having rights and responsibilities in writing, you open your business up to lawsuits. Talk to an attorney about writing out solid employment agreements.

4. Assessing your property agreements

If you have a thriving company, you may need to move to a new location. But think twice before you sign a multi-year lease for a new office. If calamity hits your business, you do not want to be stuck paying for a commercial space for years.

Operating a business may have its stressful moments, but as long as you take action, you can avoid a lot of problems. Consider these four areas and make sure your business is not at risk of costly legal complications.
